Contract & Terms of Service

1. Introduction

This Terms of Service Agreement (“Agreement”) is entered into between The Urban Kada (“Company”, “we”, “our”, or “us”), located at:

Unit 4 – 5484 Tomken Rd, Mississauga, ON L4W 2Z6, Ontario, Canada

and the purchasing customer (“Customer”, “Client”, “you”).

By placing an order, making payment, accessing our services, or purchasing any product, you agree to be legally bound by this Agreement.

If you do not agree, you must not make a purchase or use our services.

2. Products & Services Provided

The Urban Kada provides jewelry and gemstone-related products and services, including but not limited to:

• Gemstone Jewelry

• Kada Bracelets

• Gold-Plated Jewelry

• Silver Jewelry

• Fashion Accessories

• Custom Jewelry Orders

• In-store Purchases

• Online Orders

• Jewelry Consultations

• Promotional Offers

Services and products may include:

• Product consultations

• Online and in-store purchases

• Custom order requests

• Product images and descriptions

• Packaging and delivery services

• Promotional discounts and campaigns

All products are sold for personal use only unless otherwise agreed in writing.

3. No Guarantee Disclaimer

By purchasing from The Urban Kada, you acknowledge and agree:

• The Urban Kada does NOT guarantee any spiritual, astrological, health, financial, or personal outcome from any gemstone or jewelry product.

• Product appearance may slightly vary due to lighting, photography, screen settings, or natural stone variations.

• We do NOT guarantee uninterrupted availability of any product.

• Results, satisfaction, and usage experience vary by individual customer preferences.

4. Eligibility

To place an order, you must:

• Be at least 18 years old or have guardian consent

• Provide accurate billing and shipping information

• Agree to comply with all store policies and applicable laws

5. Payment Terms

• Full payment is required before orders are processed or shipped unless otherwise agreed in writing.

• All prices are listed in Canadian Dollars (CAD).

• Applicable taxes may apply.

• Payments are processed securely via authorized third-party payment processors (e.g., Stripe, PayPal, Square, Shopify Payments, or equivalent).

If payment is incomplete or declined:

• Orders may be canceled or delayed.

• Shipment may be withheld.

• Access to products or services may be suspended until payment is completed.

6. Strict No Refund Policy

The Urban Kada maintains a strict no refund policy.

By making payment, you agree that:

• All sales are final.

• No refunds will be issued under any circumstances.

• No refunds for change of mind.

• No refunds after order confirmation.

• No refunds for custom-made or personalized products.

• No refunds for shipping delays caused by carriers.

• No refunds for incorrect customer-provided shipping information.

This policy applies regardless of personal, financial, or other circumstances.

7. Order Hold & Suspension Policy

If any outstanding balance exists:

• Orders may be placed ON HOLD.

• Shipment may be delayed or canceled.

• Access to promotional pricing or services may be revoked.

Order processing resumes only after full payment is received.

8. Intellectual Property

All materials including:

• Logos

• Product images

• Videos

• Branding

• Product descriptions

• Website content

• Marketing materials

are the exclusive intellectual property of The Urban Kada.

Customers may NOT:

• Copy product images

• Reproduce branding

• Resell content without permission

• Use materials for commercial purposes

• Distribute copyrighted content

Unauthorized use may result in legal action.

9. Limitation of Liability

The Urban Kada is not liable for:

• Allergic reactions

• Misuse of products

• Shipping delays

• Lost or stolen packages after confirmed delivery

• Indirect or consequential damages

• Customer dissatisfaction based on personal preference

All purchases and usage are at the customer’s own risk.

10. Credit Card Authorization

By submitting payment information, you authorize The Urban Kada to charge your selected payment method for the total purchase amount including applicable taxes and fees.

Payments are processed in CAD.

Card details are processed through secure PCI-DSS compliant payment processors.

11. Fraud & Chargeback Protection Policy

The Urban Kada enforces strict anti-fraud measures.

By making payment, you confirm:

• You are the authorized cardholder OR have lawful permission to use the card.

• All information provided is accurate and truthful.

If a chargeback is initiated:

• Orders and customer access may be immediately suspended.

• Evidence including order records, delivery confirmation, communication history, and transaction data may be submitted to the bank.

• Fraudulent chargebacks will be disputed aggressively.

Any fraudulent dispute may result in:

• Permanent service refusal

• Collection proceedings

• Legal action

• Reporting to financial institutions

Unauthorized chargebacks after receiving products constitute breach of contract and may be pursued under Ontario law.

12. Code of Conduct

Customers must maintain respectful and professional communication.

Harassment, abuse, threats, discrimination, or misconduct toward staff may result in refusal of service without refund.

13. Privacy

Personal information is collected for:

• Order processing

• Communication

• Shipping and delivery

• Administrative and legal records

Data is handled in accordance with applicable Canadian privacy laws.

14. Governing Law

This Agreement shall be governed by the laws of the Province of Ontario, Canada.

Any disputes shall be resolved exclusively in the courts of Ontario.

15. Binding Agreement

By completing payment or placing an order, you acknowledge that:

• You have read and understood this Agreement.

• You agree to all policies.

• Electronic acceptance constitutes a legally binding agreement under the Ontario Electronic Commerce Act.
